Defense wants Jessica Kelley's murder trial moved out of Bernalillo Co.

ALBUQUERQUE, N.M .— Jessica Kelley’s defense team wants her murder trial moved outside of Bernalillo County.

She is expected to go on trial for the murder of 10-year-old Victoria Martens in January 2019.

Kelley’s lawyers said they would like her trial moved to Taos, McKinley or Rio Arriba County to avoid “major media attention” and what they perceive as possible bias.

In another motion to the court, Kelley's lawyers also claim the state bugged their client’s jail cell without a warrant.

The defense claims the officer who placed the bug didn't ask permission.

The defense is requesting to interview the officer and has also asked the judge to not allow any of the recordings as evidence.

Kelley's defense also wants to limit the number of gruesome pictures from the crime scene, as well as from Victoria's autopsy.

A judge has not ruled on any of the motions.

Kelley’s trial is set to begin in January.
