ALBUQUERQUE, N.M. -- A family claims their son's school did not notify them when he was pricked by a dirty needle at a school.

The family has filed a lawsuit against Mark Twain Elementary, Albuquerque Public Schools and Superintendent Raquel Reedy. According to court documents, the incident happened when the 5-year-old boy was playing at the school's playground in 2014.

The lawsuit states the boy went to see the school nurse but the mother was never told about the incident. It wasn't until the boy's mother saw the mark on her child later that evening that she reportedly went to the nurse the following day to find out what happened.

Court documents state the nurse confirmed the incident to the child's mother. The suit accuses the school and APS of negligence.
