ALBUQUERQUE, N.M. – A quiet stretch of the Bosque trail near Sagebrush Church was mostly empty Sunday morning, even with a packed parking lot of churchgoers nearby.

"(A) little bit of bikers, but sometimes I won't see anybody in the area when we're walking," said Lyssa Hansen, who often frequents the trail by the Rio Grande. "We do three to four miles at a time."

Hansen said she goes down the trail a couple times a week, making sure to stick near the church so she feels safer.

She said she's alarmed – but not surprised – to find out a woman was running on the trail Saturday morning only to find herself in a dangerous situation. According to court documents, James Chavez was within inches behind that woman with his penis outside his pants.

The woman told police she saw a man with a sword and a black sheath about two feet in length strapped to his leg. Court documents state she said she was afraid she would be attacked or raped.

Police say the woman was able to break away and call for help. Fellow runners heard her and helped her get to safety while Chavez continued running and took off his sweatshirt.

Police say they found the man just north of the Open Space Visitor Center. With the help of the K9 unit, they bean bagged him in the stomach before arresting him, court documents state.

Chavez is being charged with aggravated assault and aggravated indecent exposure.
