Judge recuses himself from hearing for man accused of killing family

ALBUQUERQUE, N.M.— Judge John Romero recused himself from the amenability hearing for Nehemiah Griego Friday.

He made the decision after prosecutors raised concerns about Judge Romero having a side conversation with a defense expert who had testified Thursday. 

Judge Romero was not discussing the case, however, prosecutors still felt like the conversation was procedurally inappropriate.

Nehemiah Griego, who  is 21 years old, was 15 at the time he shot and killed five members of his family.

The amenability hearing will decide whether a judge feels Griego has been receptive to treatment. Testimony detailing Griego's treatment has been sealed from the public.

No word on when the new hearing will begin or what judge will preside over it.
