Witness fails to attend hearing in suspected cop killer's case; warrant issued

ALBUQUERQUE, N.M. -- In October 2015, Albuquerque Police Department officer Daniel Webster was shot and killed during a traffic stop. Almost two years later, the trial is approaching for the man accused in the shooting, Davon Lymon. But there's one problem.


The attorney general's office says a key witness, Savannah Garcia, is not cooperating. Authorities say Garcia was on the back of the motorcycle when Lymon killed Webster.

"The witness that we're here on for the deposition did not show up," a prosecutor said in court Tuesday. "She was personally served, repeatedly called. She received text messages and responded."

Prosecutors claim Garcia is homeless. After searching for her for nearly a year, the attorney general's office found her almost two weeks ago.

"She seemed disoriented, so I meticulously went through the paperwork to advise her of the court date, the PTI date and the information for contact for our office," a special agent in the attorney general's office said.

Special agents say Garcia is 50 pounds lighter than she appears to be in a 2016 booking photo. They say she's suffering from excessive drug use.

"On both arms, she was wearing a short sleeve shirt at the time that I made contact with her," the special agent said. "On both her arms on the inside on the inside of the elbow, there were several marks that I believe to be intravenous drug use."

When she was a no-show Tuesday, the state filed two motions -- one for a material witness warrant to be issued and the other to request a recorded disposition when she is captured. Prosecutors worry she might succumb to her addiction.

The judge granted those motions and issued a $25,000 warrant for Garcia's arrest. It will require her to be held for five days so officials can get her deposition.
