Prosecutors want 15-year-old murder suspect held in jail pending trial

ALBUQUERQUE, N.M.- A 15-year-old who is accused murder faced a judge Tuesday.

Jassiah Montoya is accused of helping kill Calvin Kelly in July.


Prosecutors believe Montoya is too dangerous to be released back into the community.

Court documents show Montoya was one of the people accused of setting up Calvin Kelly for a robbery.

Those documents say Kelly took off running and was shot in the back by another man who was in on the attempted robbery.

While Montoya is 15 years old, Tuesday’s pretrial detention hearing was set in District Court, not Juvenile Court, an issue his lawyers were fighting over.

Montoya will stay in jailed until his next pretrial detention hearing is scheduled.

Montoya is one of three people connected to the murder of Kelly.

One of the other two - a teenage girl - Gisell Estrada was released before trial, and the accused trigger man, Adam Cazares, is still in custody on an unrelated charge.
