A judge ruled Winston Scates can be out of jail while he waits for his trial to begin.

Scates was arrested last Friday, on the same day his grandson, 21-year-old Leland Hust, was also placed in handcuffs. The two live in the same house.

Hus is accused of sexually assaulting and killing 6-year-old Ariana Romeo. Police were tipped off to the alleged abuse by Scates while investigating young Ariana's death, connecting him to a separate victim via DNA evidence.

Hust was set to appear in court last week, but that hearing was postponed.
