AG wants priest held in jail pending rape trial

SANTA FE, N.M.- A former Catholic priest, accused of raping a six-year-old boy, faced a judge for the first time Monday afternoon.

Marvin Archuleta, 81, sat alone in a holding room in Santa Fe as he spoke with Judge David Segura via video conference.

“This court has no legal authority to set any conditions of release for you on this matter,” Judge Segura told Archuleta.

The former priest was arrested Friday at his northeast Albuquerque apartment. The arrest was the result of a two-year investigation conducted by the New Mexico Attorney General’s Office.

Archuleta is accused of raping a six-year-old boy in 1986 inside Holy Cross Catholic Church in Santa Cruz. He also faces kidnapping charges.

Court documents state when Archuleta raped the boy, he put holy water on his back and repeated the phrase: “This is God’s love, this is how we show God’s love.”

On Monday, the New Mexico Attorney General’s office signaled their intent to keep Archuleta locked up.

“We believe this individual is a danger to the community and no conditions of release would properly protect the community from him,” said David Carl, a spokesperson for the New Mexico Attorney General’s Office.

Archuleta told the judge he intended to seek the help of a public defender.

Within the next five days, a judge will decide whether Archuleta will remain locked up or released. His preliminary hearing is scheduled for February 20.
