Police say in March of last year, officers were called to a restaurant in Clovis for reports of a battered child.  64-year-old Bruce Bender had reportedly hit a six-year-old in the head because the child was sitting on their knees at the table after Bender had told them not to.

Officers located Bender in the parking lot of the restaurant where they said he became aggressive and refused to comply with officers.

Bender has prior felony convictions and faces up to four and a half years in prison.

His sentencing date has not been set yet.
