Herrell still refusing to concede 2nd Congressional District race

ALBUQUERQUE, N.M.- The Republican who ran for New Mexico's 2nd Congressional seat is not ruling out legal action after inspecting about 8,500 absentee ballots from Dona Ana County.

Following her election loss to Democrat Xochitl Torres Small, Herrell had the ballots impounded so her campaign could examine them. 

In a Facebook post, Herrell said, "Once our team analyzes the various reports of inconsistencies we will be able to determine whether further legal action is appropriate to protect the integrity of our elections."

Torres Small was certified as the winner of the race on Nov. 27. She won by 3,722 votes.
