Tracy Pena is charged with 12 counts, which include child abuse and conspiracy.

Details about the plea agreement have not been released. However, prosecutors are working to set up a hearing.

Prosecutors believe Jeremiah was killed by the son of his mother's boyfriend.

Court documents say Jordan Nuñez, 20, tortured Jeremiah daily with a homemade spear or a shock collar.

He claims his father, Thomas Ferguson, forced him to abuse Jeremiah.

Ferguson committed suicide after he was arrested in connection to Jeremiah's death.
