Court documents filed yesterday in Doña Ana County District Court end the Special Prosecutor's appointment to the case and state that the case "possibly needs to be reindicted for Voluntary Manslaughter with a firearm enhancement."

Chan has been accused in the 2014 shooting death of Jeremy Martin, which he maintains was self-defense.

His two previous murder trials ended with hung juries.
