Murder charges dropped against Santa Fe teen

ALBUQUERQUE, N.M. – The District Attorney in Santa Fe confirmed prosecutors are dropping an open count of murder and tampering with evidence against 17-year-old Zachary Gutierrez.

Gutierrez was arrested for the alleged crimes on October 6.

Steve Aarons, Gutierrez’s defense attorney, said he obtained cell phone video footage from another teen who witnessed the shooting, claiming that police had the wrong suspect and that Gutierrez was innocent.

“There is some evidence that the shooter was speaking in Spanish and Zach doesn't know any Spanish,” Aarons said. "I think the evidence will eventually bear out that he (Gutierrez) was not the shooter"

While criminal charges against Gutierrez are being dropped, District Attorney, Marco Serna, said Gutierrez is still a suspect.

Meanwhile, Gutierrez is doing time for a probation violation. He is set to be released from juvenile detention on December 13.
