Court takes up lawsuit in 2nd Congressional District race

DONA ANA COUNTY, N.M. - The battle over ballots is taking center stage in a Dona Ana County courtroom Friday.

Republican Yvette Herrell filed a lawsuit after the Secretary of State declared Democrat Xochitl Torres Small the winner in the Second Congressional District race.

According to the suit, Herrell is calling for more than 8,000 ballots to be impounded and investigated for improprieties.

Thousands of ballots were left to be counted the day after the election. After those ballots were counted, Torres Small pulled ahead and Secretary of State Maggie Toulouse Oliver declared her the winner.

The Republican Party of New Mexico says there is a responsibility to look into ensuring the integrity of the election.
