Albuquerque man charged with rape, robbery in Carlsbad

CARLSBAD, N.M. – A man who is alleged to have sexually assaulted a woman inside a convenience store and then barricaded himself inside the store Sunday now faces criminal charges.

Members of the Eddy County SWAT Team arrested Kenneth Colby Miller, 37 of Albuquerque Sunday at a Roadrunner Convenience Store in the 1200 block of West Pierce Street, according to Carlsbad Police.

Court records state that an employee at the store said that Miller had come in and began talking with her. He then grabbed her from behind and took her into the back room where he sexually assaulted several times.

While in the store he also is alleged to have taken $60 from the cash register. The store employee called police after escaping from the store.

Miller refused to leave the kitchen of the store, according to court records. SWAT team members then entered the store. He was tased four times before being taken into custody.

Miller is charged with three counts of criminal sexual penetration in the third degree, as well as one count each of robbery and larceny.
