Fabian Gonzales Trial: Examining the fourth suspect theory

ALBUQUERQUE, N.M. — Tuesday was Day 10 of testimony in the Fabian Gonzales trial. He’s facing child abuse and tampering with evidence charges for his role in the death of 10-year-old Victoria Martens.

In court, the detective who prosecutors believe solved the mystery of her death was on the stand for a second straight day. He is the one who reworked the entire case and came up with the theory that an unidentified man is responsible for Victoria’s death.

The theory directly goes against what the defense is trying to convince the jury – that Fabian Gonzales’ cousin, Jessica Kelley, is the killer in this case.

Kelley took the stand at the beginning of the trial and told the jury a man – looking for Fabian – entered the apartment and killed Victoria. Then Kelley said she and Gonzales tried to cover it up and clean up.

The detective on the stand said he’s convinced Kelley is telling the truth. He secretly recorded Kelley while in jail, and reviewed the male DNA left on Victoria’s body. However, the defense disagreed.

The state has not rested their case, yet.

Michelle Martens, Victoria’s mother, is expected to be on the witness list for the defense. Many are anxious to hear what she has to say about the theory.
