Woman who threw baby in dumpster to be released from jail

Alexis Avila – the Hobbs woman convicted of child abuse for throwing her baby in a dumpster – is getting out of jail.
Avila is appealing the ruling and requested to be released while that process plays out. Her request was initially denied in September, but she appealed that decision too and won.
Judge Kristina Bogardus and Judge Jane Yohalem of the appeals court ruled Avila is not a flight risk and can be let out as she waits for a ruling on her appeal.
